1. About the app and these terms

Vabita is a mobile application for mothers and pregnant women: it lets you find gatherings near you, sign up for them and meet the other participants, and it offers the chat of each gathering and private messages.

The application is operated by Vabita.si, Lokarje 41a, 1217 Vodice, Slovenia. These terms are a contract between you and the operator. When you create your profile, a single checkbox accepts these terms, the Privacy Policy and the Community Rules and declares that you are an adult; the app records the version of each of the three documents and the time of acceptance.

Each version of the terms carries a date and is published at a public address; after a substantive change the app asks for your renewed consent.

2. Who may use the app

You may use the app if you are at least 18 years old. You confirm your adulthood when creating your profile with an explicit declaration that is part of the single confirmation; the app does not ask for or store your date of birth. The declaration of adulthood is your own statement.

You need your own Google or Facebook account to sign in. You may use one account, and your profile information must be truthful and must not mislead other users.

Completing your profile requires at least one entry about a born child or about a pregnancy. Without one of the two the app cannot be used, because the gatherings and the connections it offers are meant for exactly that period of life. What this means for your data is described in the Privacy Policy.

3. Purpose of the app

The app is meant for mothers and pregnant women to meet and make arrangements. It is not a childcare service and does not verify the identity, background, or suitability of its users.

Meeting in person is your decision and your responsibility. Please follow the Community Rules.

4. Your account and conduct

You are responsible for the content you share in your profile and messages. Harassment, threats, hate speech, impersonation, unsolicited advertising, disclosing other people's personal data, and any unlawful content are prohibited.

For a child the app keeps the date of birth, the optional sex and the chosen illustration. The date of birth and the sex are private and only you see them; other users see only the age stage and the illustration. Do not publish names or health data of children — your own or others'; there are no fields for them and they do not belong in free text either.

You can send images from your gallery into a conversation. Send photos of other people and of children only with their consent or the consent of their parents; you are responsible for the images you send. Every member of the conversation can save an image to her gallery.

You choose your child's illustration yourself. The app only suggests one from the age stage and the sex you entered; what the illustration tells others is your own choice.

5. Pregnancy

The fact that you are pregnant and your expected due date are data about your state of health. You may enter them voluntarily and only with a separate explicit consent, which the app shows at the moment of entry and records with the version of its text.

We publish these data to nobody: they are not in your public profile, not in the participant list and not in chats. The week of pregnancy is calculated when it is displayed and only you see it.

When your child is born, you turn the entry into a record of a born child; the expected due date is deleted at that moment. You can remove the entry at any time, which withdraws the consent.

6. The directory

This version of the app has no directory of users: there is no entry point to it and no new public directory profile is created. You reach another user's public profile only through a gathering both of you are signed up for.

If the directory is ever reintroduced, it will require a new, separate consent; the existing visibility settings are not used until then.

7. Gatherings and meeting in person

Gatherings are created only by users to whom the operator has manually granted the organiser role, and by the operator itself. You can apply for the role in the app (Profile › Soustvarjaj skupnost); the operator decides on the application and tells you the decision in your conversation with Vabita. Applying is no guarantee of the role. The operator may withdraw the role at any time; withdrawing it does not remove gatherings that are already published.

An organiser is not an employee of the operator and is not its authorised representative. She is responsible for the content, the running and the safety of her own gathering. The role means that the operator confirmed her by hand; it is not a guarantee of her conduct.

The meeting point of a gathering must be a public place. A home address, or any other private space, is not allowed as a meeting point; you can report such a gathering in the app and the operator will remove it.

Signing up for a gathering is a disclosure: the organiser and everyone signed up, including those who sign up later, see your display name, avatar, approximate-area label and the age stages and illustrations of your children, as well as your messages in the chat of that gathering. Participants of the same gathering can open your public profile and start a private conversation with you. If you are the organiser, those signed up for your gathering see the same public profile of you. The app tells you this before your first sign-up and you confirm it yourself.

The exact meeting point and the full description of a gathering are visible only to the organiser and to those signed up; the list of participants is not public. The app does not read your device location and does not check whether you attended.

The organiser may remove a participant from a gathering; the removed participant is notified, loses access to the meeting point and to the chat of the gathering, and her place is freed.

The label "Pregnant women welcome" describes a gathering and not its participants; signing up for such a gathering is not a statement about your state of health.

Attending is your decision and your responsibility, including the supervision of your children at the gathering. The app conveys information about a gathering; it does not organise it.

After the gathering the organiser marks which of the people signed up actually came. The mark is for her and for attendance statistics; a participant does not see it.

8. Sharing a gathering outside the app

You can share a gathering as an image and a link on a social network or by any other route. The shared image and link carry only the public data of the gathering — its type, title, date, time, general location and any "Pregnant women welcome" label — and never the meeting point, the participant list or the number of sign-ups.

Content you post on a social network is governed by the terms of that network. The app does not record who shared what.

The link opens the gathering in the app; the web page it leads to shows nothing about the gathering.

9. Polls about the next date

After a gathering has ended, its organiser may open a poll about the next date. Voting is voluntary; you can change or withdraw your vote while the poll is open.

Your vote is seen by the organiser and by you; the other participants see only the number of votes for each option. When the poll closes, a new gathering is created with the winning date, and it signs nobody up automatically.

10. Moderation

The operator may hide, temporarily suspend, or disable a profile that violates these terms. With every measure you see the reason and a contact for appeal.

You can appeal a measure via the contact in the Contact section; appeals are handled within a reasonable time.

You can report any profile, gathering or message with the `Report` action. The operator reviews the report — the administrator or a person with the role Podpora skupnosti (Community support) who works for the operator in the admin portal; we never disclose your identity to the reported user. A reported message shows the operator only that one message, not the whole conversation.

You can block another user. A block prevents messaging in both directions and hides her from your lists; it does not hide her public profile, and the blocked user is not told.

Alongside these terms, the Community Rules apply; you accept them together with these terms, and they describe the conduct expected in chats and at gatherings.

11. Deleting your account

You can permanently delete your account at any time in the app (Settings → Account). Deletion is immediate and irreversible. What remains after deletion, and why, is described in the Privacy Policy.

12. Limitation of liability

The app is provided as is, without a guarantee of uninterrupted or error-free operation. The operator is not liable for users' conduct inside or outside the app, including in-person meetings.

Nothing in these terms limits the rights granted to you by mandatory consumer-protection law.

13. Changes to these terms

The operator may change these terms. A new version carries a date and is published at the public address. After a substantive change the app asks for your renewed consent at your next sign-in; without it you can delete your account or sign out. The same applies to a change of the Privacy Policy and of the Community Rules.

14. Governing law and disputes

These terms are governed by the law of the Republic of Slovenia. Disputes fall under the competent court in the Republic of Slovenia, subject to mandatory jurisdiction rules for consumers.
